Compliance Review Program

The Compliance Review Program is designed to ensure compliance with conditions, plans or drawings as approved by the Zoning Commission (ZC) or the Board of Zoning Adjustment (BZA), and to mitigate complaints about possible violation of the conditions. Specifically, it is designed to allow OZ to verify that an Applicant is in compliance with the final order of the ZC or the BZA. Entities such as ANCs, business organizations, community organizations or citizens, may file a complaint using Form 300 against any applicant.

Steps in the Complaince Review Process:

  • While on the DCOZ website, you may access Form 300 by Clicking into ‘Application Forms’ under Services on the blue side of the page. Scroll down to Form 300 (Compliant of Non-Compliance with the Condition(s) of a BZA/ZC Order), print the form front and back. Fill out the form completely, providing enough information to clearly describe your complaint. Attach any relevant information that may help the review process.
  • Submit one original and ten copies (mail, email or in person) to:

  • OZ notifies all parties and government agencies listed on the order in question.
  • OZ reviews the complaint, order, plans and drawings.
  • OZ meets with the Complainant to discuss the complaint, to gather more information if necessary, and to outline the steps OZ will take.
  • OZ meets with the Applicant and requests whatever information or documentation is necessary to verify that the Applicant is in compliance. If the Applicant is out of compliance, OZ works to return the Applicant to full compliance
  • OZ meets with other parties or persons as necessary.
  • OZ finds the Applicant in compliance with their BZA or ZC order and issues a Report to that effect.
  • OZ refers the Applicant to DCRA and requests that all appropriate action be taken to bring Applicant into compliance. Appropriate action is pursuant to Titles 11 and 16 DCMR Chapter 32 and can include fines and/or the revocation of a certificate of occupancy.
